5. Dispute Resolution Clause
1. General Dispute Policy
Solver Solution acts as a neutral facilitator between Buyers/Students and Vendors/Instructors. While we are not a party to the individual transactions, we provide a structured Dispute Resolution Process (DRP) to maintain platform integrity.
2. Resolution Process for Courses (Students vs. Instructors)
Disputes regarding course quality, missing materials, or instructor support must follow this path:
- Step 1: Direct Communication: The Student must first use the “Q&A” or “Contact Instructor” feature within Tutor LMS to seek a resolution.
- Step 2: Platform Mediation: If the Instructor does not respond within 48 hours or the issue is not resolved, the Student may file a “Dispute Ticket” with Solver Solution.
- Step 3: Final Decision: Solver Solution will review the course content against the marketing description.
- If the course is found to be significantly “not as described” or incomplete, the Instructor may be required to issue a credit or fix the content.
- Note: General “dissatisfaction” is not grounds for a refund, as students are expected to review course outlines before purchase.
3. Resolution Process for Software (Buyers vs. Vendors)
Because a 7-Day Free Trial is mandatory, disputes over software functionality are handled as follows:
- Pre-Purchase Responsibility: The Buyer is responsible for testing the software during the 7-day trial.
- Post-Purchase Disputes: Disputes are only valid if the full license key is not delivered or if the software fails to launch due to a verified vendor-side bug within 72 hours of purchase.
- Ineligibility: Disputes based on “changing your mind” or “compatibility issues” that could have been identified during the trial will be automatically closed in favor of the Vendor.
4. Resolution Process for Physical Goods (Buyers vs. Vendors)
- Damage/Defects: If a physical item arrives damaged, the Buyer must provide photo evidence via the Dokan dashboard within 48 hours of delivery.
- Non-Delivery: If an item is not received within the estimated shipping window, the Vendor must provide valid tracking. If tracking shows the item was not delivered, the Vendor must issue a replacement or refund.
- Mediation: Solver Solution will hold the payout to the Vendor in “Escrow” until the dispute is marked as resolved.
5. Binding Arbitration & Platform Authority
Costs: Each party shall bear their own costs during the mediation process.
Final Word: By using Solver Solution, all parties agree that the Platform’s decision in a dispute is final regarding the distribution of funds held in the platform’s escrow/wallet.
Legal Action: You agree to attempt mediation through our DRP for at least 30 days before pursuing any external legal action or credit card chargebacks.
